The Order ProcessPlease complete the order request form to start the order process.I will then contact you to confirm I have received your order and will contact you again, normally within two weeks, to confirm I’ve accepted the order. Sometimes I reject orders or commissioned work, such rejection will be at my own discretion.Finished work can be provided in the following file formats: JPEG, PDF, PNG, TIFF.The work will be provided via email or a file sharing website depending on size.Payment is via PayPal, details will be given on acceptance of your order. However, exceptions can be mutually agreed.You can find everything you need to know about me, Loaf of Toast, and my artwork on this website before you order.Terms and ConditionsWhen you buy or commission work from me you are agreeing that:Use of the WorkI shall retain all intellectual property rights in the work. You may use the work1. for educational or charitable purposes;
2. for your own personal use including avatars, phone or computer wallpapers, and personal website/profile displays;
3. to print or create an otherwise physical reproduction of the work as long as it is for your personal use only (ie. NOT for sale).
You may not use the work for redistribution or external projects, commercial or non-commercial (i.e. t-shirts, mugs, public flyers, etc.) unless otherwise discussed.You are NOT authorized to change, modify, edit or use my works without my permission.I reserve all rights not expressly granted in these terms including, but not limited to, the right to post your finished artwork in my gallery for any reason unless discussed and agreed otherwise beforehand.You will not use all or any part of the work to train any machine learning or AI model, or knowingly permit any third party to do so.CopyrightI retain my moral rights under Copyright to be identified as the author of the work. I grant you right to use and reproduce my name Erin Campbell for copyright notices and my username ‘Loaf of Toast’ in connection with the work.You will not use the artwork for any purpose that is defamatory, obscene, or otherwise harmful to my reputation.You will notify me if you become aware of any actual, suspected or threatened infringement of the Copyright.I warrant that the work will be an original work.PaymentPayment details will be given to you when I accept your order. For commissioned work you will pay:1. 50% upfront before work commences (“Initial Fee”); and
2. 50% when the work is completed but before receipt of the final work (“Final Fee”).
DelaysI’m not responsible for any delays outside my control. If supply of your work is delayed by an event outside my control, such as illness or incapacity, I will contact you as soon as possible to let you know and keep you informed as far as reasonably possible of the anticipated length of delay. As long as I do this, I won’t compensate you for the delay, but you can contact me at [email protected] to cancel the contract.CancellationBy purchasing online you have a legal right to change your mind. This must be before you download the work. For commissioned work if you terminate before the work has commenced the Initial Fee will be refunded, once work has commenced, I will retain the Initial Fee and the Final Fee shall not be payable.To let me know you want to change your mind, contact [email protected]I will pay any refunds as soon as possible and within 14 days of you telling me you’ve changed your mind. I will refund you by the method you used for payment. I don’t charge a fee for the refund.I can end my contract with you for a product or service and claim any compensation due to me if:1. You don’t make any payment to me when it’s due and you still don’t make payment within 14 days of my reminding you that payment is due;
2. You don’t, within a reasonable time of me asking for it, provide me with information or cooperation that I need to provide the commissioned work.
ComplaintsIf you think there is something wrong with your product, you must contact [email protected]. I honour my legal duty to provide you with products that are as described to you on my website and that meet all the requirements imposed by law.Any complaints should be raised with me via email at [email protected]LiabilityI’m not responsible for losses you suffer caused by me breaking a contract if the loss is:- Unexpected. It was not obvious that it would happen and nothing you said to me before I accepted your order meant I should have expected it (so, in the law, the loss was unforeseeable).
- Caused by a delaying event outside my control. As long as I have taken the steps set out in the section on delays outside my control.
- Avoidable. Something you could have avoided by taking reasonable action. For example, damage to your own digital content or device.
To the extent that you use a work for the purposes of your trade, business, craft or profession then, save in respect of any liability which cannot legally be limited, my total liability to you for all losses arising under or in connection with any contract between us, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, shall be limited to what you paid for the work and all claims for loss of profit or indirect or consequential loss are wholly excluded.Change of TermsI reserve the right to change these terms at any time.Governing LawThese terms are governed by the laws of England and Wales.
